Data controller

PerfectaMente SAS, Tax ID (NIT) 910798822-0, a Colombian company domiciled at Carrera 20 #185-58 Of. 801, Bogotá, Colombia.

Privacy contact: email contacto@perfectamente.tech (subject: "Habeas Data") and postal mail to the registered address. Office hours: Monday to Friday, 8:00–18:00 COT.

Personal data we collect

From the contact form: name, email address, company (optional), information about relevant dates (optional), and the message you send us. We also receive attachments, email signatures, and any personal data you share in subsequent correspondence.

Automatic technical data: IP address, user agent, timestamp, and page visited. We process this data for operational security, abuse prevention, and technical diagnostics.

Cookies: a functional cookie named "pm-tech.lang" remembers your language preference for one year. It is strictly necessary and does not require prior consent (ePrivacy Art. 5.3).

Site analytics: we use Vercel Analytics in privacy-first mode — no persistent cookies and IP addresses are not stored in clear text.

Please refrain from sending sensitive confidential information (strategic plans, production data, trade secrets) through this form without a prior confidentiality agreement in place.

How we use your data

(i) Reply to your contact request and send you the requested information or quote.

(ii) Manage the pre-contractual relationship and, if we reach an agreement, perform the resulting contract.

(iii) Comply with legal accounting, tax, and judicial-defense obligations.

(iv) Prevent fraud and abuse of the contact form (anti-bot filter).

(v) Improve our site through aggregated and anonymized analytics.

We do not use your data for advertising profiling, automated marketing, nor do we sell or transfer it to third parties for commercial purposes. We do not carry out automated decision-making with legal effects on you.

Data processors and international transfers

To provide our services we work with the following data processors, who access your data solely under our instructions and confidentiality agreements:

Vercel Inc. (United States) — site hosting and privacy-first analytics.

SMTP email provider — delivery of email originated from the contact form. The connection runs through our own email infrastructure, with credentials and certificates managed by PerfectaMente SAS.

Cloudflare, Inc. (United States) — anti-bot verification (Turnstile) for the contact form. Cloudflare receives an encrypted token and minimal technical data (IP, user agent) solely to validate that the request is not from a bot. We don't use Turnstile for profiling.

Google Fonts (Google LLC, United States) — delivery of the site's web fonts.

These processors may store or process data outside Colombia. International transfers are based on Article 26 of Law 1581/2012 (data-subject authorization and contractual clauses providing an adequate level of protection). For EU visitors, transfers to the United States rely on the EU–US Data Privacy Framework or Standard Contractual Clauses (SCCs) where applicable.

Data retention

Form data without conversion to client: maximum 24 months from the last contact.

Active client data: for the duration of the contract plus 10 additional years under Article 28 of the Colombian Code of Commerce and Article 264 of the Tax Statute.

Data for legal defense: until the applicable statute of limitations expires.

Server technical logs: 90 days.

Functional cookies: automatically expire after 12 months or when you clear cookies in your browser.

Your rights as a data subject

You have the right to: (a) know, update and rectify your data; (b) request proof of the authorization granted; (c) be informed of the use of your data; (d) file complaints with Colombia's data protection authority (SIC); (e) revoke authorization and/or request deletion when no legal duty of retention applies; (f) access your data free of charge.

Procedure. Write to contacto@perfectamente.tech with subject "Habeas Data", identifying yourself (name + ID) and describing the request.

Inquiries (information access) are addressed within a maximum of ten (10) business days, extendable by up to five (5) additional business days (Art. 14 Law 1581/2012).

Claims (correction, deletion, revocation) are addressed within a maximum of fifteen (15) business days, extendable by eight (8) additional business days (Art. 15 Law 1581/2012).

If you believe we did not properly address your request, you may file a complaint before the Superintendencia de Industria y Comercio – Delegatura para la Protección de Datos Personales (www.sic.gov.co).

If you contact us from outside Colombia

If you contact us from the European Union, United Kingdom, Brazil, Mexico, or another country with specific data-protection regulation, we recognize the equivalent rights provided under your local law (GDPR, UK-GDPR, LGPD, LFPDPPP, CCPA/CPRA, among others), including where applicable: access, rectification, erasure, portability, objection, restriction, the right not to be subject to automated decisions, and the right to lodge a complaint with your supervisory authority.

Write to the same address (contacto@perfectamente.tech) indicating the applicable jurisdiction and the specific request.

Security

We apply reasonable technical and organizational measures to protect personal data: TLS-encrypted transport, credentialed access with multi-factor authentication where applicable, storage with providers holding recognized certifications, least-privilege principle, and periodic reviews.

In the event of a security incident compromising personal data, we will notify affected data subjects and the competent authority within the applicable legal deadlines.

Minors and automated decisions

This site and our professional services target adult businesses and professionals. We do not intentionally collect data from minors under 18.

We do not carry out automated decisions with significant legal effects on data subjects.

Changes to this notice

We may update this notice when our practices change or regulation requires it. The last-updated date appears at the bottom. Material changes will be communicated visibly on the site and, where applicable, by email to active clients.
